Highly likely. They needed a black employee for some quota and he was the “best” available.
Holder is now going after employers for screening out felons, because of the disparate impact on blacks—and this guy didn’t even have a felony conviction.

There were so many red flags here that I would never have this guy working for me. Let’s begin with the general discharge. I don’t know how the security forms read these days but there used to be a question: were you ever discharged from the military for less than honorable reasons. General discharges had to be explained. Another question: were you ever arrested, taken into custody or whatever for any offense, if so, explain.
These were probably removed as being too inquisitive, surely for security reasons, no one should be disallowed from a job, Yeah, right.
Unfortunately a “secret” clearance I think only requires a national agency check and a few written inquiries like former employers. Anything above requires a full field background check which takes time but in cases like this would have shaken out this scum before he got to the gate. Then again, that was years ago, today he is from a protected group and that trumps all.
