She isn’t making the case that the Syrian strike would be then justifiable, only that the reasons for considering one would be different.

Her entire thesis seems to be comparing Assad with Saddam Hussein, and showing how the Saddam regime did things hundreds of times WORSE than Assad, yet the media and the Demonrats (but I repeat myself) were the first to scream like little girls when it was time to fight Saddam.
