Group sues FBI for records after Michael Hastings’ mysterious death

A journalist and a researcher have sued the Justice Department for access to the Federal Bureau of Investigation’s records on the late journalist Michael Hastings.

The lawsuit follows the FBI’s failure to respond to separate Freedom of Information Act requests for records on Hastings submitted by journalist Jason Leopold of al-Jazeera and Massachusetts Institute of Technology researcher Ryan Shapiro.

Agencies are required by statute to notify applicants about whether it will fulfill their requests within a 20-working-day period of the initial application.

In the hours before his death, which was ruled an accident by the Los Angeles Police Department, Hastings emailed Wikileaks’ lawyer Jennifer Robinson that he was being investigated by the federal government.

Staff Sgt. Joseph Biggs — who knew Hastings when he was embedded with Bigg’s unit in Afghanistan — told KTLA Hastings had blind copied him on an email sent 15 hours before his death, notifying colleagues that federal officials were interviewing his “close friends and associates.”

Leopold, a personal friend of Hastings, wrote in a piece published on the Freedom of the Press Foundation’s website that a government investigation into Hastings would not be a surprise.

“Given the nature of Hastings’s investigative work and the revelations that have surfaced about the government’s interest in journalists’ sources it wouldn’t come as a surprise to me if some agency was looking into Hastings’s journalistic activities,” said Leopold

On July 24, Forbes revealed that computer security researcher team Chris Miller and Chris Valasek could wirelessly manipulate a moving automobile with a laptop. Miller and Valasek’s work served to bolster speculation that Hastings’s vehicle was hijacked via a cyber attack, resulting in his tragic death on June 18.....................This is the most interesting part of this case.

Well, it’s not actually part of this case, since there is no evidence that anyone “hacked” Hasting’s vehicle. It’s just wanton speculation.

To me, the most interesting part is that Barnaby Jack who was hired to do just that abruptly dropped dead at age 30. No cause of death released...

In less than 15 years, it will be mandatory for all vehicles to have black boxes. Any older vehicle without one will need to be retrofitted. Not retrofitting an older vehicle will be illegal and punishable by a fine and possibly prison.

It will be impossible to move around freely. They’ll know where you are at all times. They monitor your sleep patterns via your phone’s camera. They monitor your Internet usage. They monitor when you go to and from work. They monitor if you use public transportation. They monitor if you move about by bus or plane. They monitor your location with the GPS in your phone. They monitor when you start your workday and when you leave. They monitor how much you spend online and at points of sale. With Obamacare, they’ll monitor everything about your health and your body and determine if you are eligible to be saved if you become gravely ill.

We are no longer free people, and I fear humanity, barring a direct X-class flare or nuclear holocaust, will never be free again.

One would have to assume that evidence existed in the first place in order to answer those questions, which I will not. You don’t assume an outlandish possibility happened, without evidence, and then make excuses as to why you can’t produce the evidence. Instead, one should assume the outlandish possibility did not happen until evidence can be produced to the contrary.

I agree, it's a fertile field for speculation, especially since the article on vehicle hacking came out, but I'm very dubious on this wreck being caused by sinister elements.

Pop culture? You do know that's the mnemonic for the elements of evidence needed for a circumstantial case, don't you?

They are necessary (but not by themselves sufficient) elements for a criminal case to proceed.

In this particular case, they are augmented by deliberate destruction of evidence in direct violation of the families wishes, the fact that the pizzeria surveillance video shows a flash before the car collides with the palm tree, the sudden and unexplained death of a skilled hacker known to have been working on software take-overs of motor vehicles, the total and instant involvement of the crashed vehicle in fire, and the distance of the engine and transmission from the main crash scene, and the fact that the victim notified his friends that he needed to get out of dodge because he found out something.

But if you're happier thinking your government would never resort to force to control us, more power to you in your blissful little bubble.

Pray tell, how would you prove it was hacked? You can’t. If there was a hack, it more than likely was not stored in the non-volatile memory of the car systems impacted by the hack. You can verify this yourself, if you have the technical know how.

So in this case, if you could get it to jury trial, it would have to be about the circumstances surrounding what happened.

Many crimes have no *direct evidence*, and yet someone gets convicted. That is why we have juries.

I would love this sent to trial, but no one knows who to prosecute.
