Schultz Assistant Testifies About Delivering Confidential Sandusky File

Senior Vice President for Finance and Business Gary Schultz’s assistant testified that she delivered her boss confidential documents about Jerry Sandusky after becoming aware that the former football coach was charged with sexually abusing young boys. At this point in November 2011, she also knew about the investigation surrounding Schultz but “just wanted to help him out.”

To receive Kimberly Belcher’s cooperation, the prosecution granted her immunity for removing documents and tampering with evidence. Belcher replaced Joan Coble in 2007 as Schultz’s top administrative assistant. Dauphin County Judge Todd Hoover approved the move.

She had worked in the vice president’s office for four years by the time charges were filed against Sandusky.

A president’s council meeting was called by President Graham Spanier on Saturday, November 5, 2011 – Belcher said she typically would not attend the meeting but Schultz requested her presence. At that time, Belcher was not aware of Schultz’s confidential file on Sandusky or even who Sandusky was.

Although Spanier assured those in attendance that business would proceed as normal, Schultz did not return to work on Monday, November 7.

“Earlier in that week, Gary let me know he would not be returning back to work,” Belcher said. “We had to coordinate a time to get personal items out of the office.”

At this point, Belcher testified she was aware of the allegations against Sandusky. Although given no confirmation from her boss, Belcher said she realized that if Schultz had a file on Sandusky, it would be under lock and key in his bookcase.

“I wanted to be helpful,” Belcher said. “I thought (Schultz) should have those notes to look it.”

Upon looking at the Sandusky file in Schultz’s drawer, she saw handwritten and typed notes about the former assistant football coach’s inappropriate conduct with young boys.................

The big story of yesterday's media frenzy was McQueary's statement about Paterno.

How did they miss the testimony of these other two witnesses who blew holes in the whole Conspiracy of Silence thing???

This was interesting:

After Belcher’s testimony, the last witness of the day – Information Technology Services employee for Penn State John Corro – was called to the stand.

He testified his services were first requested in April 2011 and then again in November 2011. Corro was asked by Penn State’s general counsel Cynthia Baldwin to collect data in the form of emails from Schultz, Spanier, athletic director Tim Curley, assistant football coach Mike McQueary, and head football coach Joe Paterno.

He was told in turn to turn over emails found to the Freeh group, the attorney general’s office, and other investigators.

Nothing really noteworthy was said during his testimony, although it was interesting to hear that Schultz’s inbox had the largest amount of stored data and Spanier’s inbox was almost empty despite receiving hundreds of emails per day.

As I remember - I heard someone call into a radio show or something - or maybe it was here on FR - and the take was that Spanier - the former president of Penn State - was a pro-gay, manipulative, evil bastard who sort of put into place the enabling atmosphere that maybe had a chilling effect on reporting someone like Sandusky. Does that resonate with anyone else? Is Spanier likely to skate on this or does he have some serious legal liability?

Also interesting that it now appears that louis didn’t have to do a whole lot of exhaustive detective work after all - when baldwin just orders an IT lackey to do it for him.

I’d also like to know who the “other investigators” are/were in this manner.

I don’t trust onward state. There were a few mistakes they made yesterday that made it out on twitter.

The transcripts should be up by Thursday on the Dauphin County website.

Yep — that all appears to be true.

I also suspect that when the SHTF here Spanier tried to stay above the fray and dump everything on Schultz and Curley — making them take the blame as if he’s only the President of the University — what would he have to do with any of this.

I am no spanier fan (by ANY stretch of the imagination), but none of this makes any sense. What does make sense is prosecutorial misconduct coupled with MM’s ever changing stories.

These guys are in court because they weren’t told much more than MM saw js in the shower with a kid. That’s it.

By the time the OAG got done with the story, it was anal rape (something to this day MM says he never said) and all hell broke loose.

Linda Kelly should be charged - and I think she will be at some point. The latest uncovering of the janitor’s story is another complete FAIL on the part of the OAG.

Here's more from Harmon's testimony:

Harmon testified that he was not told about there being another reported incident involving Sandusky and a young boy in 2001.

Had he been aware, Harmon said he has no doubt he would have contacted the district attorney’s office to pursue an investigation.

What??? Is Harmon a moron??? From the Freeh Report after the 2001 incident Harmon was called by Schultz and asked of the 1998 incident was still in his computer.

What did Harmon think that Schultz was communicating to him when he asked if the file was still there??

More than just a wrong date in the janitor incident.
The defenders of the current narrative, who don’t know much about the Sandusky case, try to dismiss the new evidence as Petrosky getting the date wrong. He got a lot more wrong than that.

There were many inconsistencies with this incident. The employment information on the janitor basically slammed the door on its plausibility.

The Commonwealth stated the incident happened between Nov 20-27, 2000, on a weekend of an away football game.

1) The season ended on Nov 18, 2000.

2) The last away game was Nov 11, 2000.

3) The witness Petrosky testified the team was playing Ohio State (September 23, 2000).

4) The crime scene changed between the grand jury report and the trial.

5) Petrosky said he called the police in March 2011, after reading an article in the CDT about the “grad assistant” witnessing a shower incident. That information wasn’t published until November 2011.

6) At the grand jury, Petrosky said he was INSIDE the locker room cleaning when he was approached by the eyewitness, Calhoun.

7) At the trial, Petrosky said he was OUTSIDE the locker room and entered to find Calhoun trembling and shaking

8) At the grand jury, Petrosky said the upper bodies of Sandusky and the child were blocked (not visible).

9) At the trial, Petrosky said he didn’t see the upper bodies because he was looking down. Prosecutors stated there were no obstructions in the locker room.

10) Petrosky claimed the Calhoun witnessed the crime after both he and Calhoun had been in the shower room not less than 10 feet away from Sandusky. This does not fit with Sandusky’s pattern of disengaging with victims when others were present. Both Victim 4 and Victim 1 confirmed that was Sandusky’s pattern.

11) The second hearsay witness, Jay Witherite, who testified at the grand jury, did not testify at the trial. No explanation was provided for his absence, which was required to allow the hearsay testimony of Petrosky (see Commonwealth v. Barnes).

Conclusion: The janitor incident doesn’t hold water, yet Louis Freeh said this:

“The janitors, that’s the tone on the bottom. Ok. These are the employees of Penn State who clean the locker rooms in the Lasch building where young boys are being raped. They witness, what is probably, in the report, the most horrific rape, that’s described.”

It’s time to slam the door on this incident and Louis Freeh.

In addition - the previous work by Ray uncovered that the janitor wasn’t even employed by the University until Dec 31 (start date) of that year.

You sound like a Penn State / Paterno apologist. Jerry Sandusky was mysteriously “put out to pasture” in 1998 - right after the first accusation/investigation. Harmon said he definately would have pursued Sandusky had PSU notified him of the McQueary witnessed incident. Sandusky’s crimes were clearly known and covered up by Paterno and the other Penn State officials in the loop.

The fact is that the 2001 incident is practically meaningless in the grand scheme of Sandusky’s crimes.

PSU officials got an uncertain report from McQ and they definitely reported it to Second Mile.

There is also evidence that the report made its way to DPW. The bottom line is that DPW did not act on the report.

Abuse after this incident did not occur on campus, thus could not have been concealed by PSU officials.

Moreover, no abuse incidents were tried and convicted for the years 2002 through 2004, so how was it that PSU officials were endangering children or in a conspiracy of silence?

There were no crimes!

JS coached the defense in 1999. Even freeh got this right - stating there was no connection to js’s retirement and the 1998 incident.

JVP told js long before 1998 that he would never succeed him as the HC because he didn’t take it seriously enough and spent too much time on his charity.

JS took a special state employee retirement offer (to all state employees) in 1998 and came back for one year as a contractor to coach the defense in 1999. That was the Lavar Arrington/Courtney Brown defense that woefully underperformed.

Pedo State should have been bulldozed to the ground and then nuked from orbit just to be sure. Paterno’s statue should have been shipped to the Ft. Sill Artillery Range for target practice.
