They were most likely going to be thrown out anyway when SCOTUS ruled it was unconstitutional. Now we will never know one way or another on this crucial issue because that case will most likely be dropped.

Yes, but with this deal they'll be replaced with candidates who are EVEN WORSE. Obama has carte-blanche because he knows they'll get an up or down vote. Supposedly the General Counsel of the AFL-CIO has already been nominated.
