I can see more than a few in the Bay Area more concerned about how the blunt object survived the encounter than concerned about the innocent waiter.

The waiter may be partly at fault if he was intelligent enough to evaluate the character of his community and he chose to stay there and go out amongst them.

As Americans, all of America is ours. Maybe then, by that line of thought, he should have just moved out of the country entirely?
