Florida Judge Allows Manslaughter Charges for George Zimmerman – Up to 30 Years in Jail

Conviction by any means necessary.

Judge Nelson reduced charges against George Zimmerman today to include manslaughter.

Manslaughter charges would put Zimmerman behind bars for up to 30 years.

The Daily Caller reported:

Judge Debra Nelson ruled Thursday that the jury in the George Zimmerman trial will have the option to convict Zimmerman of manslaughter for the shooting death of Trayvon Martin, but that they won’t be able to consider third-degree murder.

The highest charge against Zimmerman is second-degree murder. Under Florida law, that charge is an unlawful killing which “evinces a depraved mind regardless of human life.”

Zimmerman’s defense said they only wanted the jury to consider the initial second-degree charge. “We don’t want a compromise verdict, just like we don’t want a jury pardon,” said Zimmerman attorney Mark O’Mara on Wednesday. “We want a verdict based on the facts of the law and that’s an acquittal.”

In an apparent surprise to Zimmerman’s defense, state attorneys also sought to include a charge of third-degree murder against Zimmerman Thursday morning. They argued that Zimmerman committed child abuse against Martin who was 17-years-old when he was killed.

From Earlier—– The judge in the George Zimmerman trial will decide today if the jury can consider lesser charges, including aggravated assault in the case.....

In Florida, a second degree murder charge is always paired with a manslaughter charge in case the jury decides that the evidence did not meet the threshold for send degree murder but did meet the threshold for manslaughter.

This is by design and perfectly normal in Florida and in many other states.

Don’t go looking for problems that don’t exist.

Wouldn’t they have to re-try the case, since the whole defense was structured for 2nd degree murder?

Only if the goal is justice.

Zimmerman will go to jail by any means necessary. There he will have an accident. Look for a civil rights charge.

You may be a good one to answer Zhang Fei's question; "Wouldn’t they have to re-try the case, since the whole defense was structured for 2nd degree murder?"

I'd like to know the answer to that question too.

“In Florida, a second degree murder charge is always paired with a manslaughter charge...”

Interesting to know. So in Florida, it’s common practice to add charges once the trial is over?

Just out of curiosity...

Would the jury decide the punishment if there is a conviction...or the whacked out judge?

The answer is no, because manslaughter is what's called a "lesser included offense" to second degree murder, meaning that every element of manslaughter is already an element of 2nd degree murder.

Something is not right here. The defense spent the whole trial trying to convince the jury that he is not guilty by reasonable of doubt (the much higher threshold) and then, without a new trial, the jury are automatically offered a lesser option of manslaughter.

If I’m not mistaken, there’s already several active threads that claim the judge did not allow the lesser charge to be entered...........you might want to check that out.

Child abuse against a six foot tall 185 lb. street-fighting football player!?!

OK, I can tap my fingers rhythmically on the table so from now on I wish to be known as a legendary rock drummer.

The six women will find him guilty of MS because they want to find him guilty of something. I just know this will happen and then it will be appealed on many grounds. This “whore for the left” judge will frame things so that the jury will be allowed to misinterpret the law and find Zimmerman guilty. I hope I am wrong but I just know it down deep that I am not.
