This so-called judged threw out the prosecutions post-trial charge of ‘child abuse’ and instead informed the jury they could convict on the basis of a manslaughter charge instead - a clear example of the dialectic! Instructing the jury on the lesser included offense of manslaughter is mandatory in any murder case under Florida law.
