SACRAMENTO, Calif. (AP) — Gov. Jerry Brown is making one final bid to delay a federal court order requiring the state to release nearly 10,000 inmates by year's end to improve conditions in California prisons.

The administration on Wednesday asked U.S. Supreme Court Justice Anthony Kennedy to delay the order forcing the state to immediately take steps to further reduce its prison population.

If he refuses to intervene, the state has said it will begin freeing inmates to comply with the lower court order, which is intended to improve care for sick and mentally ill inmates.

Kennedy oversees appeals from western states.

California officials petitioned the U.S. Supreme Court on Wednesday to release the most populous state from a court order demanding it reduce its prison population by about 10,000 inmates this year to ease crowding.

The state’s application to high court Justice Anthony Kennedy says conditions have improved in the 33-prison system in recent years, despite federal court rulings that overcrowding caused problems with mental health and medical care for inmates.

The move is part of an ongoing feud between Governor Jerry Brown and a panel of three federal judges over conditions in a state prison system that has also been plagued by hunger strikes and occasional violence.

Fortunately I am thousands of miles away from CA so I am appalled that so called humanitarian progressives like Jerry Brown would treat prisoners, the victims of ‘the corporations’ so inhumanly.

First things Dems do when they get full power in a state is to give the ex-cons the vote, like O Malley did here in Maryland.

I am sure they will 'fit in'

Liberals did not like the 3 strike laws. This is a back door way of overturning that law

How much pain and suffering and how many deaths will be the direct result of letting thousands of criminals back on the street?

Release them all to the offending judge’s home town.

If they are good enough to turn loose on the public (that’s you and me) They are surely good enough to turn loose on the judge’s spouse and children.

The only problem with this story is it is a LIE, See Article 3 of the US Constitution, In all cases where a STATE is a party to the action, THE US SUPREME COURT SHALL HAVE ORIGINAL JURISDICTION. What this means is simple, NO STATE is bound by ANY COURT other than the US Supreme court and has no Obligation whatsoever to even entertain an INFERIOR COURT. Just cuz the USSC ignores the Constitution does not mean A State has to. The Governor is within his RIGHT to tell the JUDGE and INFERIOR COURT to go Pound sand, probably has the absolute right to ARREST AND CHARGE any Judge on any Inferior Court with Deprivation of Rights under color of Authority, as well as a whole host of other crimes, like FRAUD... If a sitting Judge on an inferior court UNLAWFULLY ORDERS a STATE to COMPLY with an UNLAWFUL ORDER in direct contradiction of the US Constitution, is it Felony Extortion?? I think so.

I’m guessing 50 percent or more of those prisoners are illegals. Let the pot smokers out. Send the non violent illegals home.

“Experts with the state Department of Justice predict residents will buy 725,000 rifles, pistols and shotguns in 2012, nearly twice the number they purchased five years ago, when 370,628 were acquired.”

As far as I can tell, as of of 2012 CA’s recidivism rate for the first three years after release is 65%. It actually dropped in the last years or so, but it is still 20% higher than the national average. 45% of the ones that go back do so because of ‘parole violations.’

If one worked for the CA prison industry, I’m not sure you would be too upset about any of it too much.
