Oral arguments were heard yesterday in the United States Court of Appeals for the Fifth Circuit in Louisiana in the case of United States of America vs. John Thomas Shipley, seeking to overturn the former FBI agents convictions in 2010 for dealing firearms without a license. Shipley, who has already served his sentenced time in prison a halfway house, is appealing in order to clear his name.
Shipley first came to this columns attention when a gun he sold to a former El Paso County Sheriffs Deputy turned up at a Mexican crime scene. It soon became evident from a source close to this correspondent there was more to the story than what the government was claiming and the media was reporting. Shipley maintained he was a collector. The government charged him with being a dealer. Despite there being no firm fixed standards to ensure consistent application of the rules, the jury sided with the government. Shipley and his family continued their fight to clear his name. And in an unbelievable development, a full day of testimony affecting the appeal and in the custody of the court was lost.
Add to all that an unlikely trafficker, whose exclusion from the indictment against Shipley led a source close to the case to conclude it was because the ATF would have to provide discovery materials that would prove the ATF knowingly allowed that gun to walk.
