Judge Snaps at Zimmerman Atty After He Objects to Her Asking Whether Zimmerman Will Testify
The Blaze ^ | 10 July, 2013 | Madeleine Morgenstern

The judge in George Zimmerman’s murder trial had a contentious exchange with one of Zimmerman’s defense attorneys Wednesday when he repeatedly objected to her asking his client whether he planned to testify in his own defense.

Judge Debra Nelson reminded Zimmerman that he was not required to testify, but when she asked whether he would like to, defense attorney Don West cut in, “I object your honor.” Nelson overruled his objection before asking again.

“I object to that question — ” West repeated.

“Overruled! The court is entitled to inquire of Mr. Zimmerman’s determination as to whether or not he wants to testify,” Nelson said.

"Why was Zimmerman sworn in by the judge?"

I'm not a lawyer, but it appears that she was openly spiting the Fifth Amendment by ordering him to talk, and hoping to use his words in the case.

After the six women Jury convicts Zimmerman, I will assume this episode and many others will speed the Appeal Process right along.

I just hope GZ will survive in Prison until then.

She was looking for him to openly invoke the 5th. In order to make himself look guilty.

If this six woman Jury goes PC and ignores the overwhelming evidence of self-defense and convicts Zimmerman, who volunteered to help protect his neighborhood, then God help these same jurists if they ever have to face thugs like the ones in the video linked below. Because they're going to be complaining even more about "where have all the good men gone."

That question should be asked when the jury is not present.

Actually. She should not have even asked the question. If the defense does not call him, that is their right - she has no business trying to subtley cajole him to testify.

OTOH, if the defense did call Zimmerman to testify, it is entirely proper for the judge to inform him that he was not required to do so.

Do judges routinely ask this question? Or is it left to the attorney to say so?

Riddle me this.. can she vacate the decision and render a guilty verdict from the bench?

No. A judge can only vacate a guilty decision in favor of an acquittal.

“Overruled! The court is entitled to inquire of Mr. Zimmerman’s determination as to whether or not he wants to testify,” Nelson said.

Another left-wing entitlement.

The Casey Anthony Judge has said publicly he was surprised she was found not guilty based on the evidence presented at the trial.

The George Zimmerman judge seems to have decided Zimmerman’s guilt before the trial even started!

Or she is trying to make the point to the jury that he is not testifying, over and over again. She did everything except say, “Well if you are innocent, what do you have to
hide?”

If you have nothing to hide, why do you have a problem with the nsa reading your emails?

I sense a pattern emerging in this new America.

I can see her moving on to a daily law show like judge judy. Either that or a few episodes of whale wars.

Zimmermans college records had nothing to do with this trial and she allowed them. Why couldn’t Zimmermans defense use Treyvon’s text messages and the internet videos of him fighting? I have never seen a case so one sided before.

Regarding the discipline or removal of Judges in Florida...

How Judges Are Disciplined for Misconduct

The Judicial Qualifications Commission is an independent agency created by the Florida Constitution solely to investigate alleged misconduct by Florida state judges. It is not a part of the Florida Supreme Court or the state courts and operates under rules it establishes for itself. It has its own Website. The JQC has no authority over federal judges or judges in other states. Complaints against state judges must be filed in writing with the JQC, not with the Supreme Court or any other state court or judge. Neither the Supreme Court nor its Chief Justice have any authority to investigate alleged misconduct by state judges or to investigate the JQC. The JQC can be reached via the Contact Information on its website or at at:

Of course, the reason for this is that every other convicted defendant claims he wanted to testify but no one let him.

The correct procedure is for counsel to inform the judge who then asks the defendant if this is his free and voluntary act.

She is doing her best to protect the jury from the truth, but even with her fat thumb on the scale, Z should walk.

Do judges routinely ask this question? Or is it left to the attorney to say so.

The Judges behavior is highly unusual, as is her entire behavior and temperament in this case.

She is openly hostile to the defense and is actively obstructing their case.

Defense lawyers are typically provided wide latitude in the defense of their clients in capitol murder cases, because of the stakes involved.

It’s not as though Zimmerman is some heinous serial killer who is obviously guilty and worthy of contempt (not that their rights should be infringed as such) and it’s also obvious Zimmerman’s prosecution is a politically motivated show trial.

Zimmermann never should have been arrested and charged in the first place, especially under Florida’s Stand Your Ground Law which was passed specifically to prevent a with hunt of an innocent person who is defending him or herself.

Given the indisputable fact that the Prosecution has provided absolutely no case against Zimmermann and the Prosecutions own star witnesses have either admitted to perjury in the case.

The few Prosecution witnesses that are telling the truth provide testimony which supports Zimmerman’s accounts of what happened, support his claim of self defense and document his remorse over what happened.

The Defense team has been respectful and professional while the Prosecution has been less civil, rather unprofessional and, most importantly , has been shown beyond any reasonable doubt to have willfully and maliciously withheld critical evidence in this case which tends to exonerate Zimmerman, which constitutes serious prosecutorial misconduct.

It was only due a whistle blower coming forward to expose the prosecutorial misconduct that his came to light, and when confronted , the Prosecution stalled and fought the release of the information they had hidden for over a year until just days before the trial

Given the above, this Judge’s hostile behavior towards the Defense and compliant attitude and lack of sanctions to the Prosecution is inexplicable.

It is now obvious that this case is a disastrous miscarriage of justice and that serious misconduct has taken place at all levels of government to wrongfully bring this case to trial.

There is a mounting backlash as people are seeing just how badly this has been handled.

She must be under extreme pressure to make Zimmerman look as bad as possible to the American public and to make sure the televised audience never sees true facts of this case so they continue to buy the propaganda and disinformation dished out by the State and the Media

This case is no longer about Zimmerman, it’s about protecting the Government Officials, the Politicians and the race baiters

This case should tear up the race card forever and it will if “Judge” Nelson is able to keep the true facts of the case from being televise to the low information voters out there.
