I've wondered about the lesser included offense issue, too. However, self-defense is self-defense, even if only manslaughter is charged and even that has be proven beyond a reasonable doubt.

I try civil cases and I wouldn't want the prosecution's case even on a more likely than not standard. From a lawyer's perspective this trial has been a nightmare for the prosecution.

And I agree that a manslaughter charge would be hard to prove as well. I just think that some other lesser charge would have been more appropriate, but this situation sadly has been driven by politics and race.

I know attorney's dont always get to choose their cases, but I would not want the prosecution's case either. Not good judgement, in my opinion. Btw, I know you can't control your witnesses do once they take the stand, but to me it seems like the witness prep for the prosecution was terrible.
