Perhaps, but it is regulated by the FCC. If everything goes - the FCC won't matter. And Ham can't be 'turned off' except by jamming. That's an advantage.

Anyone that thinks the FCC regulates the radio should listen to 14.313 Mhz for 10 years and wonder why nothing has been done.
