They obviously ‘know’ the Judge won’t allow dismissal.

That’s what I’m seeing, too.
I suppose it *could* be just an act though.
I don’t know what judges think about being overturned on appeal. I have to believe it bothers them, so they’d like not to rule capriciously and bring it on.
But what do I know.
