Probably, but he’s doing a damn good job of putting her on notice that failing to so rule will be overruled on appeal — as the case law he’s presenting amply demonstrates.

There IS the issue of whether Z can hold out until his appeal succeeds.

I think his goal is to make it clear for ANYONE paying attention that if she denies the motion she is either a blithering idiot or hopelessly biased and her very denial of the motion is the strongest evidence for both.
