The IRS cannot write penalties only Congress can do that. The House has voted to repal the law, but the IRS doesn’t have the authority to re-write the law.

I would go to the Supremes on that one. I have at least 4 votes already.

Legally, yes, at least for $$ penalties. But the IRS can write regulations that are so onerous as to amount to penalties. And it has infinite resources to harass and intimidate the average citizen. A bureaucrat at the IRS wants to destroy you, he will.

But it can and does write "regulations" that effectively do the same thing.

So what? Symbolic. Without the Commie Senate, means nothing.
My wife said that if a hot 30 yo walked up to me out of the blue and begged me to have sex with her, I had permission. We both know that ain't gonna happen.
