It’s an indication that the persecution is a) flustered and b) not really all that professional. If they were good, they’d realize just what you said and let it roll off.
The scary part is that I can see this run amok judge stooping so low as to use it to beat up on the defense team. More appeal ammunition, sure, but it’s not like they aren’t sitting on a whole case full of ammo.
