Btw the fact TM was in grassy area by house and not on street or sidewalk when z first spotted him, could be considered trespassing

Common area is to be used by all Homeowners....it's not considered tresspassing.

It was not a common area. It was a front yard. The owner of which was on Greta last night.

He was not in the common area at that time but in a plot of grass about ten by ten in front of the window/door. What we would consider our front yard

The area where the confrontation took place was common ground but because the initial area be was spotted had driveway/ door/ porch / window / sidewalk on its perimeter it could be argued that it was part of the house therefor private space
