I thought that the US Supreme count only passed the buck to the states. If that is true, then Prop 8 is still in effect until overturned by the state legislature. Yes?

Prop 8 was a State Constitutional Amendment, not just another Law. It can only be ignored, it cannot be changed unless another Constitutional Amendment amends it.
Since Prop 8 does NOT violate the Federal Constitution, and nothing the SCOTUS said changes that fact, it takes a mindless Judge to twist the Law and say it does.
Kennedy is that Jurist.
