My guess: the same people who have standing to challenge Obama's eligibility.

It was the California Attorney General who was to be defending the law.

BUt the AG was pro gay, so he dropped it.

The State of California. However they chose not to challenge and, unless they are ready to open up the court to suits from individuals and groups without standing, they had to rule this way.

So don't blame the Court in this one. Blame the administration in California, and the people who elected them.

Good question! I don’t have the answer. If there’s any good news here at least the court didn’t define or REdefine marriage and so for now it’s up to states to decide.

Probably just a matter of time.

I guess the claim is only the state of California can defend the law.

But, if one really believes in states rights as Roberts claims he does, Prop 8 should have been upheld no matter who challenged it.

The State of California on behalf of the people of California. But since state
officials decided that they were more representatives of the state Democratic Party rather than of the people of California, they punted on the case. So rule of law in California depends entirely on which faction controls the government on a given day,
