Was this guy arrested for wanting to make a theoretical machine?
He built the machine, but it was not complete. Primarily, the radiation source. So it was more than theoretical, parts of it were operational, but not finished.
The charge was conspiracy-based, needing only an agreement between two parties to work toward a sanctioned activity, not an operational 007 Q special device.
