This is a blow against federalism. All elections are local in America. There are no “national” elections. There are only two elected national offices, and they are federally elected indirectly by the Electoral College.

The founders had the right idea. I cannot believe Scalia did this.

For what it’s worth, the law was not struck down because of a Constitutional argument. It was because of the federal law.

The USSC is putting it on Congress to fix the damnthing.

TOTALLY correct ruling. Scalia et al adhered to the Constitution. Congress set up regulations, Arizona superceded them. SCOTUS invalidated Arizona. QED.

Article I, Section IV:

1: The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of chusing Senators.

If we want the rules changed, CONGRESS will have to modify the existing regulations - NOT individual States ...

From reading the opinion, all is not lost. Arizona just has to follow additional procedures.

Another thread the needle ruling. But the court basically agreed with Arizona’s points. And it ‘happily’ found an escape route to avoid declaring NVRA unconstitutional by finding that Arizona can still appeal to get proof of citizenship as part of form vs. a supposed oath.

They laid a path to address - that every state should exercise at this point.

I think an interesting approach in actual elections would be to set up two lines at election places. One for those following the full AZ law and eligible to vote for all candidates running at local, state and Federal level and other line for ‘Federal only’ voters who can not prove citizenship. After all the Federal law only affects Federal elections.

Lets see how many line up in the ‘Federal only’ line.....

Here is yet another case of the three branches of the government—the Supremes in Black, the PINO and his minions, and Commiegress—all agreeing among themselves to something that is PLAINLY NOT Constitutional. And YOU must obey because they SAY SO.

What would happen if Arizona gave the Fed the big middle digit? I’d love to see Arizona State police and Arizona county Sheriffs ARREST any Feds that attempt to interfere with Arizona’s elections.

To say the states use federal forms is not a valid reason; it’s a flimsy excuse. Wonder what the real reason for them to vote insanely is?
