Hardly. He criticized the SCOTUS for preventing the Florida Supreme Court from stealing the election for Gore.

napolitano did end up on the wrong side on that issue ~ he ignored the fact the Constitution itself does have a provision allowing for federal involvement in national elections (those for Congress, the Senate, or the Presidency) ~
