While I think his sentence is ridiculous, he did have a loaded handgun within reach of the driver, which is illegal in most states, not just Joisy.

So what? It was illegal to be educated in PolPot's Cambodia. It was a death sentence to be a Jew in Hitler's Germany. It was a 10 year sentence in Siberia to be considered counterrevolutionary in the former soviet union.

The constitution doesn't say the right to keep and BEAR arms is restricted to the government and its goons.
