It would seem that in in a situation like this, where the admin looks like won't agree to a SP, that another branch could recommend one. That may take, uh, guts on the part of the other branch, though.

I guess I don't expect the senate to ask for one and get it with 60 votes. Not. Gonna. Happen.

There is a problem with a special prosecutor. First it can take waaaay too long, particularly since the administration will stonewall and give no documentation up. Much like what happened to Ken Starr, he can be also demogogued to death, they'll call them racist bigots out to get the oh so nice and innocent first black president.
