Texas Republican Sen. Ted Cruz was born in Canada but is qualified to become president should he mount a campaign in 2016 or beyond.
Cruz was born in Calgary, and his father is from Cuba. But the Republican senators mother is from the first state of Delaware, which appears to settle the issue.
Government officials didnt exactly have to scramble for the information amid speculation the firebrand freshman senator was contemplating a presidential run and might be ineligible, considering similar questions about President Obamas birth prompted the Congressional Research Office to compile a 2009 report to try to resolve the issue.
The 14-page report by the non-partisan offices legislative attorney Jack Maskell essentially states the Constitution sets out three eligibility requirements to be president: one must be at least 35, a resident within the United States for 14 years and a natural born citizen.
The report states "the weight of scholarly legal and historical opinion appears to support the notion that 'natural born citizen' means one who is entitled under the Constitution or laws of the United States to U.S. citizenship 'at birth' or 'by birth,' including those born abroad of one citizen parent who has met U.S. residency requirements."
However, Maskell points out in an expanded, Nov. 2011 memorandum there is no Supreme Court case which has ruled specifically on the presidential eligibility requirements, although several cases have addressed the term natural born citizen. And this clause has been the subject of several legal and historical treatises over the years, as well as more recent litigation.
Cruz has excited the Republican Partys conservative base during his first five months in the Senate while annoying moderates by opposing everything from Obama Cabinet nominations to the bipartisan Senate immigration bill.

Actually, it's obvious to me that it is the case.
But, no matter. I really don't care.
His mother is US citizen Eleanor Darragh.
His father is Cuban citizen Rafael B. Cruz. (naturalized as a U.S. citizen in 2005)
Eleanor Darragh and Rafael B. Cruz were residents of Canada for years (at least four). They conducted business there as Rafael B. Cruz and Associates, Ltd.
Where they "permanent residents"?
Is Ted Cruz a "natural born citizen" of Canada?
Revised Statutes of Canada 1970:
You said>>>> “”””In 1790 there was no such thing as a “Dual citizen”. If a Woman married an American, she was automatically naturalized by marriage. (American Common Law) Congress even codified this back in the later half of the 19th Century.””””
Ok, But in the case of Obummer, his mother married a Kenyan.
Did this Kenyan Father become a naturalized US citizen by virtue of the marriage?... I don’t think so.
AND In the case of Cruz, his mother Married a Cuban man.
Did he stop being Cuban because of he married Cruz’s mother?
My Original question to Mr. Winston was.... How does this apply to Obummer or Cruz... assuming for the moment that Mr Winston’s facts were correct when he posted that
..... children born abroad to US citizen parents were to be legally counted as natural born citizens.
When both Cruz and Obummer were each born to ONLY ONE CITIZEN PARENT..... The MOTHER.... In Cruzes case Canada and in Obummer’s case ..... We don’t know.
Still waiting for an answer...
To clarify:
Eleanor Darragh and Rafael B. Cruz were residents of Canada from at least 1970, possibly earlier, until 1974.
People are so hungry for a conservative president. Yes Cruz would be a great one but I believe him to be ineligible. The dems will smile and keep their mouths shut about this while people push Cruz to run. Remember they tried to say McCain was not eligible because he was born in Panama?? Both his parents were citizens and he was born at an army base hospital - considered American soil. McCain was indeed eligible while sad to say Cruz is not. The dems will say nothing until it is too late to come up with a better candidate.
Are you a libtard pretending to be a conservative? You show all the signs...
Failing to explain your position while claiming others are wrong is a HUGE red flag.
You know, I’m getting pretty tired of jerks like you accusing me of being a “liberal” just because you’re a moron and I’m not.
I expressed my honest opinion and belief. If you don’t like it, well... I just don’t care. Because the emotional state of jerks is not my concern.
You calling someone “emotional” is the height of hilarity.
Obama naturalized as a U.S. citizen in 1983 is a statement of fact. You choose to ignore an eyewitness account of the fact because the custodians of the records have remained silent on Obama’s immigration status from 1971 to 1983.
Obot continually refer to Obama’s birth record because an examination of his immigration record proves he’s ineligible for POTUS.
What a relief that we have not opened the dangerous precedent of allowing a foreign-born person to become President of the United States of America!
