Obtaining AP phone records required Holder’s approval

The DOJ’s U.S. Attorneys’ Manual is quite clear on this point:

The Attorney General’s authorization is normally required before the issuance of any subpoena to a member of the news media or for the telephone toll records of a member of the news media. However, in those cases where the media member or his or her representative agrees to provide the material sought and that material has been published or broadcast, the United States Attorney or the responsible Assistant Attorney General may authorize issuance of the subpoena, thereafter submitting a report to the Office of Public Affairs detailing the circumstances surrounding the issuance of the subpoena….

Because this probe was secret, the second condition was not met, meaning that Holder’s approval was necessary. The manual goes on to explain:

Department attorneys seeking the Attorney General’s authorization to issue a subpoena to a member of the news media, or for telephone toll records of a media member, must submit a written request summarizing the facts of the prosecution or investigation, explaining the essentiality of the information sought to the investigation or prosecution, describing attempts to obtain the voluntary cooperation of the news media through negotiation and explaining how the proposed subpoena will be fashioned as narrowly as possible to obtain the necessary information in a manner as minimally intrusive and burdensome as possible.

ah...that makes sense. As thin-skinned as Obama is and how strongly they want to control leaks...

Funny, just as I’m typing this, Rush confirms what you said. Leaks about failed terror plots was leaked and DOJ wanted to know who was talking to the AP. Dang, you’re good ;-)

Don't kid yourselves...this goes to the oval orifice..where the buck should be stopped. Impeachment is the answer. Even if it fails it sends a strong message. The scope of this administrations misuse of power is incalculable. What are you waiting for Republicans...permission from the NYT?

Rush nailed it early this afternoon: if they would have asked, the AP would have gladly GIVEN this information to Obama.

This was about Islamic terrorism. It was not political. This shows that the Obama State Department supports Islamic terrorism more then it supports freedom of the press or freedom of speech. We saw that during Benghazi when they falsely accused some obscure video grapher instead of Islam.

Nope. It doesn’t work that way. The process for electronic intercepts, subpoenas for phone records, etc. are very specifically laid out under DOJ guidelines. Many moving parts involved initiating and maintain such investigative activity. Any departure from established regs or unauthorized investigations are deemed a criminal offense. Jail time. Nobody launches something like this without air cover, and hard copy, hand signed paperwork.

Holder is the Obama Arm, doing his will. Obama and Holder will try to stall as long as possible, hoping this storm will end soon and not much damage done to his ambitious 2nd term agenda.

However if the public outrage lasts long, Eric Holder could be replaced, it will be harder for Obama to pick the right enforcer (as Holder is a perfect fit for Obama), but there are plenty thuggish types in the leftist volunteer pool.

They are in bed with any who will maintain them or advance them to positions (jobs) they covet...and that on the Global stage as well.

The press, the people are simply pawns to move on the board.

I think what has the AP so mad is not that they investigated the airplane bomb story, but that the DOJ sought phone records that were far more comprehensive than what might have been uncovered in a specific search.

The original story was written in May of 2012. There were five reporters on the byline (and assume a couple editors). But the DOJ sought records for April and May for about 20 reporters, and for main offices in New York, Washington and Hartford CN, including the office that handles correspondence with Congress.

This was a fishing expedition under cover of a leak investigation.

There is a lot more to this story that has not been uncovered, yet.

Guess I should have said Obama Justice Department, but State Department also works. Heck, both seem to be operating on the same page. We are very close to all out war against DC. And we have 2/3 of the planet on our side.

Absolutely. Title III violations are a big “effing” deal. You can bet that as we speak, there’s more than a few attorneys over at DOJ scrambling like crabs on a hot stove.
