California bill penalizes companies for reducing employee hours under ObamaCare

230.9. (a) It shall be unlawful for a large employer, as defined in Section 14199.1 of the Welfare and Institutions Code, to designate an employee as an independent contractor or temporary employee, reduce an employee's hours of work, or terminate an employee if the purpose of the action is to avoid the employer's obligations under Article 7 (commencing with Section 14199) of Chapter 7 of Part 3 of Division 9 of the Welfare and Institutions Code.

There’s a 4’th option, but it’s doubtful they have the balsl to do it- ALL companies which will be forced to reduce hours shoudl band together and REFUSE to pay the fines- or better yet, all companies shoudl get together in a massive coalition and REFUSE to be bullied by thewir state by making it known they WILL NOT be treated like that-

but again- they haven’t got the nerve- so they will either go out of busienss, or severely lose money and just barely make it-

A good friend of mine in Modesto had his own business, but because of kalifornistan taxes and regs, he dissolved the company and went to work for someone else.

Businesses will merely go out of business and reorganize elsewhere in that case. Let’s see if the Land O’Fruits-&-Nuts can run everything through the state, then.

One of our circle of friends here in Hollywood (closet rightwing) moved 4 years ago to NV because one of the execs said that CA is the worst state to do business. You might not know this show on the Travel Channel but the HQ is now in Las Vegas. The show? well, to avoid the DU trolls, the host of this show is a good looking dude whose name starts with Z.

Juries will be allowed to infer that. And, company emails will be killers in this regard. Because companies are doing exactly that for exactly that reason, as Obama expected them to. And there will be emails in most companies discussing exactly that. The penalties are a big part of the financing of Obamacare.

Liberals are idiots, all this will do is 1) cause many small and medium businesses in CA to go out of business

and 2) The large corporations who survive will just hire less workers (or allow for attrition without replacement) thereby forcing their current workforce to shoulder more of teh work; this in turn (because human beings aren’t machines) will cause LESS production of the surviving businesses because the American worker can only do so much..

That’s what NY threatened to do to businesses- they drive businesses out of the state, then fien htem when they leave- They apaprently think they will get enough guillible young folks startign new big businesses i nthe state to make up for hte well established busiensses that left because they were driven out

If they’re liberal, they would tend to stay in the workers’ paradise, right?

AFAICS, Colorado’s liberalization was due to other factors. Those were liberals that packed up due to the high cost of living of CA (which makes them hypocrites of course, but not necessarily businesspeople). Native Coloradans never liked that segment of people to be sure.

Actually, the FTB already makes it hard. They keep trying to tax you for several years after you have left the state. They levied on my personal bank account for several thousand dollars more than eight years after I left CA, with no warning on a completely bogus claim.

It took me months to get the money back. No interest paid on the free loan they had confiscated.

What if the owner were to split the business and give one of them to his son or daugher, then only became a “manager” on paper? Same effect, yet avoids Obamacare to a degree.. Yes?

I’m pretty sure there are new HHS regulations prohibiting that, too. Common ownership means the businesses will be consolidated.

And the ONLY reason they can and will and DO get away with it is because peopel will NOT stand up for themselves in large enough numbers to put an economic hurtign on thsoe theives in congress any longer- IF enough peopel and businesses formed a conglomerate, they could cripple the government there and put them into panic mode fearign for their jobs- When greece used to be threateend by their govenrment, they would all band together, and shut down interstates, trucking, shipping and keep it shut down with aggressive protests until the govenrment relented (although that’s not workign any longer as the govenrment there is in financial ruin now- but hte point is that when hte govnerment was ok financially, and commerce was shut down by the peopel, and the gov faced losing money, they backed down)
