I heard Judge Napolitano say the same thing. He didn't seem to see the lack of an oath as a big deal. Levin, referrring to this article,on the other hand, seems to think it is a big deal that she wasn't given the oath. I don't have a clue.

Judge Andrew Napolitano: Lying to congress carries the same criminal liability and the same punishment as lying under oath to congress.
