It’s not treason. Treason is the only crime defined in the U.S Constitution. If you keep calling it treason and expect anything to come of this treason wise, you’re setting yourself up for a disappointment.
The CnC is given broad powers in regards to the military. Not responding is certainly an option of his.
Now, I’m not justifying anything, it was a cowardly choice that was made. One beneath the dignity of the office and it’s roles. Obama can’t hide from this. No matter who it is said made the decision (I.E Hillary), it’s his tar baby.

The potential treason is the underlying arms-smuggling to enemies of the country. You are correct - not responding is not treasonous, while it is cowardly and stupid.
The coverup may be illegal, as well, given that testimony to congress is covered under perjury laws.
