Rep. Sheila Jackson Lee: Constitution implies a right to health care, education

Rep. Sheila Jackson Lee took to the House floor Monday night and implied that the right to health care and education exists in the Constitution.

Ms. Jackson Lee, Texas Democrat, also made the case that the moral authority for such services is also derived from the Declaration of Independence.

“One might argue that education and health care fall into those provisions of life, liberty and the pursuit of happiness,” she said.

“Life, liberty, and the pursuit of happiness” aren’t provisions, they are not even a part of the Constitution. It is a part of the Declaration of Independence which is a founding document and declaration of freedom from the crown but NOT the fundamental law of this Republic. The closest one might come to this in the Constitution is the “promote the general welfare” phrase but again, this has nothing to do with specific rights and law since it appears in the preamble which is the mission statement for the Constitution but NOT the articles and amendments which define Constitutional law.

Rep. Jackson Lee is arguably a victim of her parents not making sure that she was taught about the federal government's constitutionally limited powers like many parents / guardians have failed to do for the last 60+ years. And if such is the case, then it's no surprise that she is now failing to make a distinction between PC, implied rights which liberal politicians use to win votes from the growing welfare class, and constitutionally enumerated rights which reflect the will of the Constitution's Article V majority.

On the other hand, speaking of Article V, since Rep. Jackson Lee has been serving the people since 1995, she should know that former Rep. Jessie Jackson Jr. had repeatedly introduced a resolution, since 2005 I believe, for Congress to propose a healthcare amendment to the Constitution to the states for ratification, but which Congress wrongly ignored doing before establishing Obamacare.

H.J.Res. 30 (109th): Proposing an amendment to the Constitution of the United States regarding the right of citizens of the United States to health care of equal high quality.
So I surmise that Rep. Jackson Lee must be trying to win welfare votes by "promising" PC rights. (This post based on premise (hope) that no federal lawmaker could be as clueless as Nancy Pelosi, but Pelosi may have some "competition.")

She doesn’t mean there is a right to health care and education. What she means is there is a right to have other people pay for her health care and education. There is a big difference. Otherwise, I should reasonably expect that others should buy me a variety of arms—it is unquestionably a Constitutional right.

Exactly so. I have made that point numerous time to liberals of my aquaintance and it always renders them speechless ... at least for a few minutes.

a right to bear arms, it demands it. Federal Papers.
