Rep. Sheila Jackson Lee took to the House floor Monday night and implied that the right to health care and education exists in the Constitution.
Ms. Jackson Lee, Texas Democrat, also made the case that the moral authority for such services is also derived from the Declaration of Independence.
One might argue that education and health care fall into those provisions of life, liberty and the pursuit of happiness, she said.

Life, liberty, and the pursuit of happiness aren’t provisions, they are not even a part of the Constitution. It is a part of the Declaration of Independence which is a founding document and declaration of freedom from the crown but NOT the fundamental law of this Republic. The closest one might come to this in the Constitution is the “promote the general welfare” phrase but again, this has nothing to do with specific rights and law since it appears in the preamble which is the mission statement for the Constitution but NOT the articles and amendments which define Constitutional law.

On the other hand, speaking of Article V, since Rep. Jackson Lee has been serving the people since 1995, she should know that former Rep. Jessie Jackson Jr. had repeatedly introduced a resolution, since 2005 I believe, for Congress to propose a healthcare amendment to the Constitution to the states for ratification, but which Congress wrongly ignored doing before establishing Obamacare.

Jackson Lee must be trying to win welfare votes by "promising" PC rights. (This post based on premise (hope) that no federal lawmaker could be as clueless as Nancy Pelosi, but Pelosi may have some "competition.")
