UPDATE: Federal prosecutors charged the surviving man suspected of bombing the finish of last week's Boston Marathon with one count of using a weapon of mass destruction and one count of malicious destruction of property resulting in death, the Justice Department said on Monday.
The charges authorize penalties including death, life in prison or a term in prison for any number of years, the Justice Department said in a statement.
Dzokhar Tsarnaev, who was seriously injured in a firefight with police before his Friday arrest, was charged in his hospital bed earlier on Monday

A smart prosecutor will hold charges in reserve, just in case he gets acquitted by an OJ jury. Failing to get a conviction of this guy would be career-ending for a prosecutor.
I know, I sure hope someone has told him.
So... if our troops had found any pressure cookers in Iraq, the liberals would have conceded that Sadaam did in fact have WMD's?
So, without charging him as an enemy combatant, and not having his miranda rights read, does this mean he will get out of it all based on that loophole?
Because all of that costs money. It cost in the time of all the lawyers, judges, baliiffs and courthouse workers. It will cost in jail costs for the prisoners waiting to get into a courtroom that’s being taken up with hearing the endless motionss that this one would involve, And governments are supposed to save money where they can, I thought. Besides, they’ve got years before the statute of limitations runs out on most of the charges, and it never runs out on murder. LIke I said, this guy isn’t going anyplace.
Is he now positive?
I wonder about that.
I'll be dead before any real justice is meted out, especially by this administration.
