It is entirely possible that the Saudi was in fact arrested or an arrest attempt was made, but rescinded by higher ups, hence the original confusion early on.

Glenn just explained that the burden of proof on this classification is rigorous. I am sure the O administration is gonna spin a tall tale in the classified briefing that he was some under cover agent or has been traded to Saudi government for a higher level perp or some sort of nonsense.
I fear the republicans will just take them at their word and the whole thing will be dropped on national security grounds. These people are slick and so far have not ever been held responsible.
