Forsyth County investigators say 48-year-old Scott Biumi, a sergeant with the DeKalb County Police Department, got upset with 18-year-old Ryan Mash, who is a senior at Lambert High School. They say Biumi got out of his car and the two exchanged words before Biumi drew his weapon and pointed it at Mash.
"I'm just like, 'I don't want to die. I'm sorry, sir. I didn't mean for any of this to happen,'" Mash recalled.

Mash said Biumi told him, "You don't want to mess with me," before putting his hand on Mash's shoulder and pulling out his gun. Two of Mash's friends were in the pick-up with him, and they say they couldn't believe what was happening.

Fire the cop. I get that. Giving an 18 year old a couple of hundred thousand for being scared I do not get. Cash does not fix the problem. What is the money for, "emotional distress?" The only people that get punished by a cash settlement in a case like this are the taxpayers. Sounds like an entitlement mentality to me.
There were a couple of times in the military I thought I was going to die because of someone's incompetence. Should their employer, the government, make me a millionaire?
Already homesick for Atlanta (not ATLANTA, but the area, where I was born and raised) and seeing these familiar faces just kicked me in the gut.
That being said, not surprised at Dekalb Co. cops. More surprised that he was white.

I have worked closely with many police officers--all fine men and women.
So one of them turns out to be a bully--a loose cannon--a nutcase--that doesn't reflect on the others. As my father-in-law used to say: "The Lord Himself picked twelve, and one of them turned out to be an S.O.B."
Law enforcement all over the country is heavily burdened, especially since the American people decided to embrace decadence (e.g. can't even manage to keep drug pushers from preying on children in elementary schools, can't manage to keep criminals from flooding in from other countries, consider it a good idea to redefine criminals as "undocumented's" or some such silliness, ignore blatant corruption among politicians, etc., etc., et al.), and if the forces of decadence manage to disarm the citizenry, the burden will become much, much heavier.
There is no substitute for self-reliance.
I am NOT sticking up for the LEO; but, something is wrong with the boy’s explanation that the cop got angry because they were in line too long waiting for their food.
Assuming the car that the kid is in is facing forward at the drive thru window, the cop comes in from in front of them, not behind them (as if he’s been waiting too long).
Something’s not right.
Kid should have pulled out his double-barreled shotgun and fired 2 shots in the air thereby eliminating any threat.

There is currently a case working its way through the courts on a off duty Seattle cop who did something similar. He had noticed a drunk driver and followed them until they stopped and then held them at gun point until on duty cops showed up.
The gist of the case was unlawful display of his firearm. SPD has lost the case in district court, court of appeal, and is planning on taking it to the Supreme Court. The court at each venue has sided with the victim who sued for being unlawfully detained. Although the court has upheld his case they only awarded him $1 but legal fees to fight for the right to draw down at anytime have exceeded $600,000!

I am all for taxpayers (like you) who refuse to take responsibility for the people they employ ... paying through the nose.
Your personal “I don’t wanna be held responsible” defiance needs to be replaced with “I will elect a sheriff and city government who will never allow this”. The way to accomplish this is to take your money - even if it costs me my money.

Sometimes it does. Otherwise, what motivation would the DeKalb police chief have to make sure that this doesn't happen again?
Sure, the chief feels embarrassed about all this now, but that feeling will soon go away. But a money judgment against his force would really keep him focused on the problem.
But I do see your point. Huge awards of taxpayer money doesn't sit too well with me either.
The money memorializes the crime. If these things didn’t cost departments/city/states/feds money then nobody would be getting fired for these things.
It helps to pierce various chromatic lines these agencies draw about themselves to protect themselves.
A punitive lawsuit compels investigation and testimony of others and in general becomes a painful experience for the offenders and their would-be friends.
If every cop that interfered with legal video recording of their public service was fined 33% pay for 1 year and the cities had to pony up a few 100k each time this happened, cops would starting thinking twice about doing things.
Screw the apology. The officer should be in JAIL the same as any other citizen would be.
Yes. The cop legally was given his authority by the city. the city is culpable for his actions under cover of that authority.

Punishment for the public. The public is responsible for their elected officials and the money is the feedback loop to tell the people their chosen badly and to chose someone else.
