Third degree murder in PA is not eligible for the death penalty. The most he could be sentenced to is 20 years per count but they could be consecutive.
From memory, I recall that the third degree murder charge is for a woman who died under his “care,” but that the intentional, premeditated killing of the born babies is being prosecuted as first degree, capital murder.
