A Tucson gun store owner has decided to rescind the sale of a military-style rifle to Mark Kelly, the husband of former U.S. Rep. Gabrielle Giffords, after Kelly said he had intended the purchase to make a political point about how easy it is to obtain the kind of firearms he's lobbying Congress to ban.
Kelly's March 5 purchase of an AR-15-style rifle and a 45.-caliber handgun at Diamondback Police Supply sparked a frenzy of reaction from both sides of the debate after he posted to Facebook a photo of himself shopping.
A background check took only a matter of minutes to complete, Kelly said in the Facebook post, adding that it's scary to think people can buy similar guns without background checks at gun shows or on the Internet.
But Kelly couldn't immediately take possession of the rifle because the shop had bought it from a customer. As a result, the store is required by a Tucson ordinance to hold the gun for 20 days to give the city enough time to make sure the weapon wasn't used in a crime.

About 20 yrs ago this gun violence death clock was put up in front of the World Trade Center, of all places. by the Gun Fighters of America, a bunch of Brady Campaign wannabes. The funding for this eyesore came from a scam artist, Robert Brennan, who eventualy did time for securities fraud. Yeah, if I bilked lots of old folks out of their life savings, I'd be, shall we say, CONCERNED if their kids and grandkids had easy access to firearms.

Kelly filled out the 4473 attesting that he was buying the weapons for himself but stated openly that he was giving the AR-15 to a third party. He committed a felony! He should now be tried, convicted and imprisoned for falsifiying the record. He was a “straw buyer”!

I guess they couldn’t or didn’t want to put the percentage numbers up there of number of guns as a percentage of “gun killings” because it would show the miniscule number that it is huh? Guess they thought New Yorkers wouldn’t be able to figure it out on their own. Wonder what the number of “Guns in America” is now? Probably well over 300 mil.
Anyway, if the gun shop has stopped the sale because of questionable intent, will this be another case of the batfe NOT going after an individual (NON-enforcement!) for attempting to buy a weapon under false pretenses? They’d probably pay one of us peons a visit but they’ll tell mark kelly-giffords just to not do it again if they say anything at all now that he is in the privileged/protected upper class.
If they sold it to him knowing he lied on the 4473, they would be committing a felony.
Mark Kelly, by his admission the gun was not for personal use and his intention was to buy it for someone else, admitted committing a felony when he lied on the form.
I think a DA needs to look into his actions.
It should be easy for law abiding citizens to obtain a gun.

What a gun shop owner told me was that he was required to refuse any sale if he felt ‘uncomfortable’ about the sale. Someone buying a gun for someone else might act abnormal, so he was supposed to err on the side of caution.

Wow, when you divide the gun killings by the number of guns, you get 0.00009599 - or 0.0096% Not even 1/100th of a percent of gun deaths to guns.
See, thats the problem with the damned form...Not that I am in anyway supporting doofushead on this...
But what if I filled out the form, with the intent to later on will the firearm to someone in the family, or sell it outright to someone else if I chose not to posess that firearm anymore...
I don’t believe I am compelled to fill out a transfer form for that kind of deal, if I am alive or not...Its my property, and I have the right to dispose of it as I see fit...(this is true in most states in this Union, IIRC)
But Mark Kelly’s intent was clear from the onset...Poorly thought out, and poorly executed...
As I have said many times in the past, you may be smart enough to command the space shuttle, but this guy is dumber than a bag of hammers in this arena...

Actually, a licensed FFL dealer can refuse to sell to anyone for any reason or no reason according to BATFE regulations.
BTW - other threads seem to dispute that Kelly committed a felony by falsifying the 4473 (gifting a firearm is cited as legal). If that is true, he should simply be incarcerted for being STUPID!
