Magpul Legal Analysis of HB 13-1224 (CO Magazine Ban)

Magpul Industries has adamantly opposed Colorado House Bill 1224 because it will not enhance public safety and will only restrict law abiding citizens from protecting their homes and families. Magpul strongly believes that Governor Hickenlooper should veto HB 1224 based on these policy grounds.

Recent reports also demonstrate that House Bill 1224 has a much broader scope than supporters intended or disclosed, as was argued on the Senate floor. Magpul retained the law firm of Holland & Hart LLP to review the scope of HB 1224’s regulations. The results were striking. The report made the following conclusions:

1) HB 1224 restricts the sale, possession, inheritance, and transfer of nearly all firearm magazines, regardless of capacity.

2) HB 1224 bans the possession, sale and transfer of certain existing firearms.

3) HB 1224 will be virtually impossible to implement and enforce.

4) HB 1224, as written, would be one of the most expansive gun bills implemented in the United States.

Holland & Hart incorporated these findings into a letter to Governor Hickenlooper urging him to veto HB 1224. Attached is a copy of the letter sent to Governor Hickenlooper on March 15, 2014, with the primary conclusions highlighted in yellow.

I have lived in Colorado my entire life (half of a century). I’m done! Moving to Montana (where my wife is from), or Wyoming, Idaho or Utah. I’d like to stay and fight it out, but I might end up killing someone - sick of these self rightous dipshit$. I’ll use a 1911 and leave a P-mag on their chest.

It's a great letter. I'm not surprised the bill was drafted so poorly given how fast the Dims rammed it through.

I'm really, really surprised this came from Holland and Hart in that the firm is chock full of liberals. I guess a conservative snuck in.

Bet folks in the military start requesting a PCS to anywhere else but Colorado ( Ft. Carson)...
Military folks enjoy firearms as much or more than anyone else.
Betcha revenues from out-of-staters drops way off, as firearms-friendly folk avoid it, just like N.Y.
All kinds of future ramifications these libtard legislatures find out...after its too late.

No joke, people have no idea how much more freedom exists in Alaska. No taxes, oil wealth funds state govt which is very conservative. We don’t even have prop taxes where I call home, unorganized community, no real local govt, no ordinances, law enforcement, ect. Nearest state police is 250 miles away and our road is closed for the winter. I really belong here in Alaska.

What the Hell do you think they are doing? Not often do you see a single company hire attorneys to try and nullify crazy legislation in their home state. What do you want from them?

Personally, I’ve been trying to decide which sights to buy for my Thureon Defense carbine. Magpul will get my dollars and support because they are trying to fight.

It’s all grandfathered. I can keep and use all of my guns and magazines for as long as I live.

The day before chickenlooper signs it, I'm giving all my firearms and magazines to my son. He is of course entrusting me with their safekeeping and routine maintenance, check firing, etc...

Maybe. Have to see what it says about possession of someone else's firearms. Of course the local Sheriff has said that as far as he's concerned he is going to assume every firearm and magazine he comes across was purchased pre-ban. Every one, from now on.

I'm tempted to follow you. As I understand it WY has no concealed carry law - you own it, you can carry it however you like, open or concealed. Love it. My company also has offices in AZ and TX. Considering them since I wouldn't have to change companies etc.

However I'm just a bit too angry over this right now. I think I'm going to stay and fight. I'm going to be as big a thorn in their side as possible. We've got a great Sheriff, I'm going to stay and support him. Hell, maybe I'll sign up as a volunteer deputy, join the posse and help man checkpoints between here and Boulder to keep the weenies out.

I don't know that it was drafted poorly. Rhonda Fields is listed as the author, but she isn't literate enough to have. She has no idea what the bill says. Someone (bloominidiot?) passed it to her.

Hick is term-limited and can't run for Senate because Udall and Bennett are his boys. He needs a gig in DC and can buy it for a few signatures.

What does he care about Colorado anymore?
