Well, one does have the right to face one's accusers. Even if they are traumatized survivors of a massacre.

I forgot that Ferguson argued with a victim on whether or not it was actually Ferguson that stood over him and pulled the trigger.

I doubt it was Justice Daniel FitzGerald that presided over that trial.

No that trial was in Nassau County, more conservative than NY County. But the judge just didn’t want to find him insane because everyone wanted him to stand trial. Clearly he was totally out of his mind and it just made the judge and court look foolish to pretend otherwise. On top of that, it was traumatic to the victims having to be cross examined by the guy who shot them! He would never have been released anyway and frankly, it made other judges take note in future cases.
