On Special Report tonight Bret mentioned that one possible change might be that the Senators would actually have to be present on the Senate floor during the filibuster. I think that this would be a good change and is as it should be. Had this been the case during the Bush years, it would have been much more difficult for the Democrats to block some very fine judges, such as Miguel Estrada.

I remember in 2006 Levin calling for taking ‘the constitutional option ’ of getting rid of the filibuster for judges and he called that filibuster ‘unconstitutional’(this is in his book too) . Her cursed the gang of 14 for that compromise.

Of course 3 years later 2009 it is O selecting judges with his Dem Senate and Levin is calling for guess what, Republican filibuster, the 'unconstitutional option'.

This is when I realized that all his big talk about putting ‘the constitution’ before everything was just more talk radio show.
