Pizza magnate wins temporary ruling on contraception coverage dispute (Tom Monaghan)

The billionaire founder of Domino's Pizza has won a temporary court victory, with a federal judge blocking enforcement of part of the health care reform bill requiring most employers to provide a range of contraception and reproductive health services.

Some business owners and their staff see that as a violation of their religious rights.

Federal Judge Lawrence Zatkoff issued his order late Sunday, saying Thomas Monaghan had "shown that abiding by the mandate will substantially burden his exercise of religion."

"The (federal) government has failed to satisfy its burden of showing that its actions were narrowly tailored to serve a compelling interest," said Zatkoff, a 1986 Reagan appointee. "Therefore, the court finds that plaintiffs have established at least some likelihood of succeeding on the merits" of their claim.

Monaghan filed the emergency petition this month, on behalf of himself and Domino's Farms Corp., a Michigan property management firm he operates, not directly related to the pizza-chain empire. Monaghan sold his majority interest in the pizza company in 1998...

Looks like the Pizza guys are leading the fight against Obamacare on religious grounds. Papa John’s is also in the fight and winning some in court.

Now if Pizza Hut, Little Caesar’s, and Godfather Pizza all jump in, the whole country will rally around them. Who doesn’t like pizza? That would be UnAmerican, n’est pas?

Let’s elect Herman Cain the commanding general of the “Pizza Brigade” of the United States. I’d love to see him go up against the Obamites on the healthcare issue.

The flag would be a big pizza with the words underneath saying “EAT ME, OBAMA”.

After tangling with him, Obama and his marxist minions, including Sebelius, would need more than healthcare to put them back together again. Duct tape and glue wouldn’t do it.

Also, all the pizza stores could put their religious objections to Obamacare in their windows. Even better, they could also tape printed letters to customers on the top inside of their pizza delivery boxes. It worked before with one would-be actor.

His name is Steve Furst and he put his bio on the inside of the top of the pizza boxes he was delivering in Beverly Hills.

Next thing he knew, he got an audition for “Flounder” in “Animal House” and the rest was comedic movie history.

Not only that, but he’s an ex-Marine. He spoke at our university for our business administration course and he just winged it, without a script. One of the best pro-American, pro-business class I ever had.

Monaghan is a former Marine. He’s never done anything to earn the title “ex-Marine” unlike John Glenn, Lee Harvey Oswald, Ron Dellums, Ron Kovic, Brian Dennehy, James Carville, Scott Ritter, Clayton Lonetree, Robert McFarlane, Mark Shields, Robert Garwood, Mike Farrell, etc.

Hooray for Domino's! With this precedent being set, maybe now the Greens and Hobby Lobby can get a break.

Pejorative headline alert. This is not a “dispute” about contraception, it is a principled conflict over the very essence of what the First Amendment means with respect to the restriction that “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof;” As a consequence, the federal government, and by the doctrine of “incorporation” the states are forbidden from expressing an opinion about a ecclesiastical matter.

By this very clause and for this reason Muslims, Amish and others were exempted from AbominationCare because in their theology it is the same as gambling and is forbidden. In my opinion, by granting this exemption from the outset it is acknowledge that AbominationCare is void any time it does so.

When AbominationCare attempts to force me as an employer to pay for the willful termination of a human life for the sake of anything other than to save the life of the mother, it is a direct violation of a religious belief that has just as much standing as does the exemption of Muslims and Amish due to insurance.

As a point leading up to AbominationCare paying for abortion, it levies a tax to pay for contraception which some people also have a principled religious-based exception to.

But this is always the way with tyrants. I am sure that many Germans objected to being forced to document the racial background of their family history for purposes of imposing and then enforcing racial purity laws. But once the initial objections are overcome by government, it becomes easier to impose the next outrage and the next until the government wears down the citizen into at state of compliance.

But we can revoke this government’s charter and redefine our relationship with it in a peaceful and thoughtful manner if we can have courage in the founding principles. The threats and dangers of the present trajectory are far more dangerous than the work product of a Constitutional Convention, a document that must be ratified by a supermajority of the surviving states.

How much more outrage must we endure before we are obligated to honor the clause in the Declaration of Independence:

“But when a long train of abuses and usurpations, pursuing invariably the same object evinces a design to reduce them under absolute despotism, it is their right, it is their duty, to throw off such government, and to provide new guards for their future security.”

I’ve been a pizza delivery driver for many years. Company policy was and is nobody could pack guns. If you didn’t like that, you had to work elsewhere.

I too am a pizza delivery guy. I work for a man who wouldn't put my safety at risk.

I understand your employer has chosen the opposite, and you've gone along with it. That's fine with me, it's your decision.
