MERIDEN, Connecticut (Reuters) - A $100 million claim on behalf of a 6-year-old survivor is the first legal action to come out of the Connecticut school shooting that left 26 children and adults dead two weeks ago.
The unidentified client, referred to as Jill Doe, heard "cursing, screaming, and shooting" over the school intercom when the gunman, 20-year-old Adam Lanza, opened fire, according to the claim filed by New Haven-based attorney Irv Pinsky.
"As a consequence, the ... child has sustained emotional and psychological trauma and injury, the nature and extent of which are yet to be determined," the claim said.
Pinsky said he filed a claim on Thursday with state Claims Commissioner J. Paul Vance Jr., whose office must give permission before a lawsuit can be filed against the state.
"We all know its going to happen again," Pinsky said on Friday. "Society has to take action."

The thing is, that they will go after the firearms manufactures.
Even if Bushmaster, Glock et al are found only one percent responsible, if the suit is for 100 million dollars.....
Thinking like a leftist lawyer, I would go after the companies that made the weapons and the dealers that sold them, even if one out of a hundred lawsuits won, and even if only for a few percent liability, one could put a lot of people out of business.
And nothing that the hysterical money-grabbing screamers are suggesting can have a milimeter's worth of additional safety...
The courts, including the Supreme Court, have repeatedly held that Law Enforcement is unable to prevent every murder or mass killing, nor do they have the obligation to do so!

So this kid heard cursing, screaming and shooting over the intercom, how is that $100,000,000.00 worse than a violent movie or video game?
This wasn’t even a kid in the room where the killing took place, there it’s a kid from that room who it’s alive, I would say that that kid it’s far worse off by watching all of her friends die.
That may well be. And in the short term there will be negatives for the state. However, its time we force the issue of the risk to them of taking away our second amendment rights. I believe they are truly liable for the deaths of those children and adults. It the attitude had been different and there were teachers, administrators, or others in the school that were armed and the public was well aware of that we all know the outcome would have been different. Sure its our taxes but they already have that and if we take more of that away from them and continue to force the issue maybe we can get across to them that shall not be infringed was there for a reason. I would hope that the general public would begin to realize that the state/fed is irresponsible by not allowing defense.

Instead of being GRATEFUL their child survived, these greedy ghouls are trying to take advantage of a mass tragedy.

Nice try. However they are responsible when they take our rights away as per the 2nd amendment they have made us vulnerable. They also use the flawed reasoning that the police are there to protect and serve so we shouldnt need guns. Shout all you want but they have put themselves into just the position you claim they dont have.
The courts also said you have to pay for others insurance and wont look at the eligibility of the usurper. So hows that Supreme Court workin out for ya? Hello?
Boy, the anti-gun people should be terrified of lawsuits like this. If the state has that kind of legal and financial liability for failing to provide safety, the state will have to disavow any obligation for public safety. It will be back to everyone has to defend themselves, the wild, wild west. Guns for everybody.
Won't get that far, the point of these lawsuits is to make the government scared and cave and settle for a fraction, say only 10 million.
The ACLU was famous for this tactic in bullying local governments to settle for taking out Christmas creches, and other traditional religious events such as school Christmas Carols who didn't want the $50,000+ expense of fighting the bastards.

If it was so obvious to foresee, then why did the parents send their child for 8 hours a day, 5 days a week and nearly 200 days a year into such a dangerous situation? The parents just proved they failed to protect their child so call in CPS and have all their school age children taken away. Sounds very much like a case of child abuse. Yum, it's popcorn time!
Totally outrageous! Bottom feeder lawyers, money grubbing parents, stupid juries that fall for this sham! Money better spent for ARMED SECURITY IN THE SCHOOL!
