Congress created the problem when it delegated to the Executive Branch its Constitutional authority to legislate. The result is an imperial executive - the goal of the Fabians.
What Americans have not been taught or have ignored or forgotten is that our government is supposed to be gridlocked. Legislation and change are supposed to be difficult and ponderous. Central Planners don’t have time to waste building a consensus. Action is needed now.
Congress simply needs to reassert its Constitutional authority to write law. Regulations are laws.
Again, it all boils down to the Constitution....or lack of making them follow it in most cases.
And exactly where did the People give their authority for Congress TO delegate their powers?
I’d say it’s pretty easy to contend that the power given to Congress by the People are not something they can delegate away w/out an amendment. Just as much as it could be argued that regulations, not written by Congress, are NOT lawful.
