If this is the case, it has to be pursued.
If he had just done it, and not really been caught with in his possession, a slap on the wrist is fine.

If they asked permission and it was denied, then they did it anyway, that is just giving the finger to the police.

Same in construction, if something ‘minute’ is iffy and can be answered with a ‘no’, best thing is to do it and hope everything comes out okay.
If you ask the inspector and he (rightfully) says no, if you go ahead and do it, you have just bought yourself a whole lot of problems if it gets discovered - and they will be looking for it once you mentioned it.
