Maybe. Maybe not.

I think that most conspiracies unfold because not all of the conspirators face the same consequences for their part.

Whoever initiated the idea of having the magazine on the set may have a tale to tell.

Whoever advised that NBC ask the police for permission will be questioned.

Whoever actually contacted the police will have to relate their communications with others.

As it is unlikely that Gregory did the actual work of obtaining the contraban, there could be a chain of people who possessed the illegal item. Each and every one of these people would be well-advised to lawyer-up. Their lawyers would probably advise anybody in a lowly position relative to the others to make a deal.

Gregory must be cautious that he doesn't end up making false statements that might get him additional time like that which Martha Stewart faced.

Gregory himself might be in a stronger position if he can credibly testify that others, perhaps including the person who contacted the MPD, lied about the MPD response and assured him that everything was fine. After all, what reasonable person would believe that he could face a year in prison for holding an item which even I, here in the Kalifornia, may possess. Kalifornia grandfathered magazine capacity and bears the burder of proof regarding importation of such items. Mere possession is not outlawed here.

My hope, as unrealistic as it might be, is that the prosecutor in DC is pro-gun. He could do the Second Amendment a lot of good by pursuing this case.
