Read the statute you cite. Under 8 USC § 1324a(b)(1)(B)(i), acceptable proof is a U.S. passport, which Obama certainly has.
This statute is not about the NBC requirement. As its title ("Unlawful employment of aliens") indicates, it's part of the employment verification system, aimed at aliens who don't have work authorization. Under 8 USC § 1324a(b)(1)(B)(ii), even a green card is acceptable proof.
