- Popular U.S. pizza chain Papa John's faces a $250 million class-action lawsuit for blasting customers with illegal text messages.
The plaintiffs allege that Papa John's ( ) franchises sent customers a total of 500,000 unwanted messages in early 2010. The spam texts offered deals for pizza, and some customers complained they were getting 15 or 16 texts in a row, even during the middle of the night, according Donald Heyrich, an attorney representing the class.
"After I ordered from Papa John's, my telephone started beeping with text messages advertising pizza specials," Erin Chutich, one of the plaintiffs, said in a statement. "Papa John's never asked permission to send me text message advertisements."
The pizza franchises sent the text blasts through a mass text messaging service called OnTime4U, which is also a defendant in the case. When Papa John's was first sued in April 2010, the franchises allegedly ended their involvement with OnTime4U's text program, after the pizza company informed its corporate stores and franchisees that sending unsolicited messages to cellphones "is most likely illegal."

I didn’t order from them last year, but if I had, and had gotten cell phone spam, I wouldn’t be supporting them either.
While I suspect there is some foul play in effect here and PJ did not intend to send all that spam, there is no such thing as legitimate spam.
Either way, the moronic law makers can’t even arrest the “Card Services” and “Rachel” credit card scammers and they trump up this 250 million BS against a legitimate company.

I’ve ordered from them and I’ve never received any texts. When you sign up on their website, there’s an OPTION to sign up for texts.. but it clearly states it’s an OPTION. People who sign up for texts were pretty much asking for it.
My problem with Papa John’s is their pizza’s are not that good. Though if these keeps up, I’ll order one in a show of solidarity.
Poor babies getting spam?.... If I could collect a nickel for each piece of spam I’ve received, I would be a trillionaire. Some folks need to get a life!
I never get text from anyone. It took some doing but I had voice messaging and text turned OFF on my phone. No text, no voice mail, no photos, just a phone the way Mr. Bell meant it to be. What’s really neat is that people sending me voice mail or text can do it, but it is autoerased upon receipt and I don’t even get a notification.
How is not wanting to pay service fees to receive unsolicited messages (or phone calls for that matter) being gullible? I don't want the hell of telemarketers turned lose on my cell phone either.
I pay my Verizon cell phone bill at the Verizon store with my debit card at a machine set up for that purpose, as soon as the receipt prints out, my phone buzzes with a text message informing me that I have paid my phone bill.

Same here. Never once have I received a text message from them. I have received emails with coupons and specials but I signed up for that.
My pharmacy was calling me every other around the clock due to an automated service they use to inform of refills. I called them back that i don’t need refills but they refused to stop the service .
I ended up calling their corporate office and threatened a $5000 small claims lawsuit for each call made from here-forth to stop the calls. Call blocking did no good because they used different numbers .
I ended up no longer doing business with any of their branches.
I now use a 555 area code number with my new pharmacy.
I block texting from my phone——problem solved........
Tort lawyers go after the “Deep Pockets”, especially when they are easy to locate.
Picture this: A Rolls-Royce lightly scrapes your car door. Then a kid on a BMX bike lightly scrapes the door on the other side. You have the license number of the Rolls but the kid races off. Which one will you seek damages from first?
If your lawyer is getting 25-35%, which one will he go after?
Lawsuit? Over spam? Time to sue the White house, RNC, DNC and every politician in the United States. My political spam must have reached into the thousands this election cycle. The audacity.
