This can get very confusing, Romney has taken both positions. Romney also claims that it is settled federal law. We don’t really know what his claimed position on abortion is currently

Governor Romney, Boston Globe, Op-Ed, July 26, 2005-—”I believe that the states, through the democratic process, should determine their own abortion laws and not have them dictated by judicial mandate.”

”But a 2007 statement by Romney at a debate might muddy Romney’s statement, in which Romney said he would be “delighted” to sign a [national] bill banning all abortions, saying it would be “terrific.”

PELLEY: Well, the platform as written at this convention for the Republicans does not allow for exceptions on abortion with regard to the health of the mother or rape or incest. Is that where you are?

ROMNEY: No. My position has been clear throughout this campaign. I’m in favor of abortion being legal in the case of rape and incest, and the health and life of the mother. But recognize this is the decision that will be made by the Supreme Court. The Democrats try and make this a political issue every four years, but this is a matter in the courts. It’s been settled for some time in the courts.
