Navy vet shot by deputy in own backyard—family seeks answers

The brother of a Navy veteran shot by a deputy in her own backyard wants the sheriff's department to admit its mistake and take responsibility for the incident.

Jennifer Orey, 36, was shot Sunday in a surprise encounter with two sheriff's deputies who were searching for a man reportedly in the area wearing a ski mask, the San Diego Union-Tribune reports. Orey was in her pajamas in her yard around 10:30 p.m. because she heard noises and thought it was her ex-husband, the newspaper reports.

Orey and Deputy Luke Berhalter came in contact and the officer's firearm discharged at point-blank range, her brother James Morgan told local Fox 5 News.

"He fired without warning, saying freeze, or anything. Then just as she saw the black smoke coming out the barrel she turned her body," Morgan said. "The bullet went through her chest and her left nipple, into her shoulder and out her pinkie."

The deputy reportedly told her, "I'm sorry, you startled me,"

The only stupid one is you. The woman went into her own yard, something she had every right to do, and was shot by a LEO who had no business and no legal right to be on her property. What kind of an idiot(you, presumably)would blame this woman and say she got what she deserved? This so called law officer should be tried, convicted of felonious assault and put away for the maximum sentence and forever barred from holding another LEO position.

I would encourage my wife to take the 12 gauge if she did go out, but it depends on where you live. She had every right to go into her own yard at night or any other time. As for your stupid statement that a LEO saw a “stranger” and shot her, the only stranger in that yard was the LEO you frickin’ idiot, it was HER yard.

The shooting was entirely preventable if the idiot shooter kept his finger off the trigger. His decision wounded an innocent.

He needs to be serving time, as any one of us would if we shot an innocent.

There is only one victim in this case, not two.

Yes.
She has a shotgun and knows how to use it.
And she has children to protect.
And living in a rural area the deputy is only 20 minutes away at best.

So, she was supposed to know those noises might be a cop tha will kill her due to his incompetence?? Cop should be going to prison for this, manslaughter at the minimum.

That’s a bunch of BS.

Recently, sometime in the last 5 or 10 years the cops have come to the conclusion that it’s ‘us vs. them’. And the ‘them’ is the typical law abiding citizen.

Cops are no longer to be trusted, let alone be our friends.

They are ‘the gang of blue suited thugs’ who must, by law, be called in certain situations, but those who are able to should wait until that situation is completely resolved before the call is made. The ‘blue suited thugs’, who are really just historians, can then come an make record of what happened.

No situation exists that can’t be made worse by calling the police.

Here in CT, we have this POS father-son cop duo....son just got a light sentence for DUI driving after a day of drinking...kills a teenager riding his bicycle home. Cops arrive at the scene....one who *takes over* the scene is the *daddy* of the drunk cop. Somehow avoids a Breathalyzer for his kid and takes him home. Since the cover-up was so blatant, State Police took over the investigation [our Staties are no angels].

Nepotism probably helped kill Henry Dang.

This immigrant family is without a son....the thin blue line gets thinner. I love that the killer-cop is separated from the general population in prison. How lovely. How convenient.

[San Diego County Sheriff Bill Gore] said the deputies thought Orey’s open gate looked suspicious, so they went into her backyard. The deputies ran into Orey, and one of them had a “spontaneous reaction.”
