It depends. If the perp pepper sprays you in order to further assault or rob you, then yes. But if the pepper spraying is the escalation of an argument, then no. If someone pepper sprays you, they have already assaulted you. In many places it would be a felony. And there is no way to know what their further intentions are, but a resonable person would be justified in fearing for their safety. And that is the standard for self defense.
