No, it was intentional. They know they don’t have a case so they’d rather have it thrown out than have him proclaimed innocent. This way they can still claim he’s guilty and only got off on a technicality.

This would also protect the parent's civil lawsuit. Being dismissed rather than found not guilty gives them a better shot at a wrongful death verdict.
